The introduction of “red flag laws” has raised the concern of many firearm owners. A red flag law is a gun control law that permits police or family members to petition a state court to order the temporary removal of firearms from a person who may present a danger to themselves or others. A judge makes the determination to issue the order based on statements and actions made by the gun owner in question. Refusal to comply with the order of the court is normally a criminal offense.
Some states such as California and Oregon have already enacted so-called red flag laws. Red flag laws differ from state-to-state and vary in name. There is a push by some to enact red flag laws across the country. As of today, Missouri has not enacted a red flag law. There are currently no bills under consideration in Missouri to enact a red flag law.
