Hi, Evan Nappen here, your Independent Program Attorney from New Jersey for U.S. LawShield. I’m here today to talk to you about red flag laws.

New Jersey has a red flag law, which is a law that allows the government to confiscate your firearms with virtually no due process. This can be accomplished by an individual talking to the police and saying they believe you are a danger, or even by a family member doing this. The police simply need good cause, with a low burden of proof, and without your participation they will come and take your guns. Then, you will have to fight to get them back in a red flag firearm forfeiture hearing.

In order to protect yourself, make sure you have a list of your guns, the serial numbers, and photographs of them, because if your gun is confiscated, we are going to have to fight to get them back. It is a big risk in New Jersey. Gun owners are vulnerable. Be careful.
