You’ve recently misplaced your permit to carry and just submitted a form in the mail for a replacement card. Does this impact your ability to carry in the state?

WHAT THE LAW SAYS

Colorado’s concealed carry law requires a permit, and requires the permit holder to carry the permit with valid photo identification at all times when in possession of a concealed handgun. Failing to produce a permit upon demand by a law enforcement officer creates the rebuttable presumption that the person does not have a permit.

Further, failing to carry and produce a permit and valid identification as the statute requires is a class 1 petty offense. A person charged with that offense, however, is entitled to have the charge dismissed if they bring to court a permit valid on the date the citation was issued, along with photo identification.

Thus, a person who carries a concealed handgun after having lost their card, and before a replacement card arrives, risks being cited under the law. But if the valid replacement card arrived by the court date for the offense, the person could get the charge dismissed by bringing the permit to court. C.R.S. 18-12-204(2)
